" Une théorie de la loi comme roman devient peu à peu le mainstream de la pensée du droit et du politique sur les deux rives de l'Océan Atlantique. Abandonnant les vieilles fables du contrat social, de l'ordre (juridique) et de l'Etat – National, cette nouvelle pensée interroge le droit à l'aide des catégories de sexe et d'interdit, de pourriture et de sacré, de violence faite à l'étranger, de genre, de personnage, de masque, de métaphore et de métonymie, de cohérence narrative et anthropologique…Une relecture est ainsi en cours de ce qu'est une personne, un corps, un Etat, et de ce qui fonde et justifie la cohérence du droit. Plus important encore, une réécriture du droit est en cours. Si la loi est un roman, il est possible de réinventer de nouveaux personnages et de nouveaux rôles, c'est-à-dire de ré enchanter les vieilles catégories de sujet, parentalité, sexualité, ou même de démocratie. Un roman nouveau pour une nouvelle politique de l'imaginaire".

"Law, a novel A theory of the law as a novel becomes the mainstream of the current legal and political thinking on both sides of the Atlantic. Leaving the olds fables such as the Social Contrat, the (juridical) Order, and the National State, this new thought questions law with concepts such as sex and the forbiden, the rotten and the sacred, the violence to the stranger, the genders, the masque, the metaphore and the metonymie, the narrative and anthropological coherency… A re reading is in progress of what are a person, a body, a State, the foundation and coherency of law. Furthermore, a rewriting of law is in progress. If the law is a novel, it is possible to create new chearacters, new roles, to re invente old institutions such as personality, sexuality, parentality and even democracy. A new novel for a new policy of the imagination.
Gilles Lhuilier is law professor at Université de Bretagne Sud. He alternates writing books on law –Introduction to law, Labour law, Corporate law…- and philosophie – The body and its representations, The return of the camps : Sangatte, Lampedousa, Guantanamo…- He wrotes in particularly about the anthropological dimension of law, the enonciation – at the hart of positive law- of symbols whitch are the fondation of humanity.
